Consultation on regulations: active farmer figure
I have a question regarding the exception to compliance with the active farmer figure (article 7 of RD 1048/2022), which says:
- The active farmer requirement is automatically considered fulfilled by farmers who, having been beneficiaries of direct payments in the previous year, based on the single application for that campaign, have received less than 5,000 euros in direct payments before the application of administrative penalties for non-compliance with the eligibility criteria or cross-compliance.
Let me give you an example: If a farmer has been receiving aid exceeding €5,000, but in the 2025 season does not meet the 25/75 rule because the aid received in the previous year was less than €5,000, could they claim this exception to qualify as an active farmer for this season? Could they rectify the situation by claiming that they received less than €5,000 in aid in the previous year? Or does this exception mean that the farmer's aid does not exceed €5,000 in any of their seasons, meaning that the farmer's aid generally does not exceed €5,000 in all previous and subsequent seasons (what was considered small farming in the previous reform)?

Dado que en este caso, el agricultor ha demostrado en la campaña presente que cumplía con el requisito de agricultor activo al superara el 25% de ingresos agrarios sobre el total, en la campaña siguiente podría acogerse a la exención del artículo 7.1 del RD 1048/2022 :
“El requisito de agricultor activo se considera automáticamente cumplido por los agricultores que habiendo sido beneficiarios de pagos directos el año anterior, con base en la solicitud única de dicha campaña, han percibido menos de 5.000 euros en pagos directos antes de la aplicación de las penalizaciones administrativas por incumplimiento de los criterios de subvencionabilidad o condicionalidad”
